South Carolina Divorce courts can award spousal support or alimony in certain separation and divorce cases.
There are several types of alimony including the following:
- Lump Sum Alimony
- Permanent Periodic Alimony
- Rehabilitative Alimony
- Reimbursement Alimony
- Separate Support and Maintenance (pre-divorce)
- Other forms of alimony may be awarded as a judge deems appropriate (e.g. medical expenses, education, etc.)
When a South Carolina family court judge considers whether to award alimony
from one spouse to the other, a number of factors must be considered, including
the following:
- Duration of the marriage
- Age of the parties at the time of the marriage and at the time of divorce or separation
- Physical condition of each spouse
- Emotional condition of each spouse
- Education of each spouse
- Need of each spouse for additional education to achieve income potential
- Employment history of each spouse
- Standard of living during the marriage
- Current and reasonably anticipated earnings of each spouse
- Current and reasonably anticipated expenses of each spouse
- Parties' property, including non-marital and property apportioned in equitable distribution
- Custody of the children and impact on employment and income
- Marital misconduct or fault of each spouse
- Tax consequences of alimony
- Existence and extent of support obligations from a prior marriage
