DUI Charge SC - defined as

operating a motor vehicle while under the influence of alcohol or drugs.  Under S.C. Law it is unlawful for a person to drive a motor vehicle within this State while under the influence of alcohol or drugs to the extent that they are materially and appreciably impaired.

DUAC stands for Driving with an Unlawful Alcohol Concentration.

Under S.C. Law it is unlawful for a person to drive a motor vehicle within this State with an alcohol concentration of .08 or more.  That determination is made when a person submits a breath sample or “blows” into the Datamaster machine (DMT), commonly referred to as a “breathalyzer.”
